  Studienarbeit aus dem Jahr 2022 im Fachbereich Jura - Andere Rechtssysteme, Rechtsvergleichung, Note: 9 Punkte, Freie Universität Berlin, Veranstaltung: Law Clinic Post Conviction, Sprache: Deutsch, Abstract: Die folgende, sich am US-amerikanischen Strafsystem sowie an den ihm innewohnenden Innocence Projects orientierende, komparative Analyse dient dem selbstgesetzten Ziel der Wissenserweiterung um die Ausgestaltung anderer Strafsysteme, dem reziproken Lernen hieraus sowie der distanzierten Betrachtung der eigenen Verhältnisse und ihrer Problematiken sowie der Ausarbeitung möglicher Lösungsansätze hierfür. Die folgenden Ausführungen befassen sich mit dem gängigen Verfahren des trial cases, in welchem über Verbrechen (felonies) verhandelt wird, lassen sich jedoch ebenso auf Verfahren über Vergehen (misdemeanours) übertragen. Die Unterscheidung zwischen den beiden Deliktstypen erfolgt dabei aufgrund derselben Dichotomie wie in § 12 StGB, wonach die Einordnung des beschuldigten Tatbegehens schlussendlich die Höhe der Mindeststrafe bestimmt. Beginnend mit dem Ermittlungsverfahren, welches vorrangig durch die örtliche Kriminalpolizei gemäß des Opportunitätsprinzips und hierbei weisungsunabhängig von der Staatsanwaltschaft geführt wird, folgt auf den Erlass eines Vollstreckungsbefehls (warrant), welcher das Bestehen einer gewissen Wahrscheinlichkeit der Tatbegehung (probable cause) voraussetzt, die Verhaftung (arrest). Sodann wird der Angeklagte im Anklageeröffnungsverfahren (arraignment) vor dem zuständigen Richter mit dem festgelegten Klagegegenstand konfrontiert und über seine Rechte belehrt - er hat die Möglichkeit der Stellungnahme (pleas) und kann sich hierbei als schuldig (guilty) oder nicht schuldig (not guilty) bekennen - zumeist zu seinem Nachteil. Statistisch gesehen enden an diesem Punkt ein Großteil aller Verfahren im Wege des sog. plea bargaining, mithin eines vonseiten des Angeklagten geäußerten Schuldeingeständnisses, da es mit Ausspruch eines guilty pleas des, die Hauptverhandlung bestimmenden, Konfliktes fehlt. Wird ein solches nicht ausgesprochen, beginnt der Richter im Rahmen der ersten Anhörung (preliminary hearing) die, der Anklage zugrundeliegenden, Beweise zu prüfen und insoweit ein ausreichender Anlass für eine Klageerhebung besteht, verkündet er einen Eröffnungsbeschluss (holding order) mit einem Verweis an das zuständige Gericht.
